Data Protection
- External Data Protection Officer -

Data protection, data security and proper handling of data have a growing influence on the decision relevant areas of a company, regardless of a company’s size and business sector. Almost every company collects, processes, and/or uses individual-related data for business operations. This concerns client data as well as data about business partners and staff.

In the above mentioned cases a data protection officer has to be appointed in all public positions (e.g. public authorities). Moreover, a data protection officer is mandatory if there are more than nine employees in a position of the private sector (e.g. companies, clubs, law firms, doctor’s surgeries, tax adviser’s offices) who are engaged with the automated handling of individual-related data.  The data protection officer must have the necessary technical qualifications and reliability for the fulfilment of his tasks.

Many companies refrain from appointing an internal data protection officer for different reasons, e.g. because there is no adequate or interested candidate, or due to the fact that the relevant costs are considered to be too high or because the task does not require a full-time employee.
